MarketMonster.co is operated by Frakle, LLC. When you sign up, Frakle, LLC is the party you are contracting with. Four documents apply, and each one has a different job.
Terms of Service
The commercial agreement: accounts and organizations, credits, subscriptions, billing and refunds, acceptable use, suspension, and how disputes are resolved.
Read this if you are signing up, paying us, or deciding what your team may do with the service.

Which document decides what
The contracts split along a single line. The Terms of Service is the commercial agreement: what you buy, what it costs, how credits and subscriptions work, what counts as acceptable use, and how a dispute gets resolved. The End User License Agreement is the software license: what we permit you and your Authorized Users to do with the application, the Application Programming Interface (API), and the Model Context Protocol (MCP) server, and where that permission stops.
The Privacy Policy is not a contract you negotiate. It is our statement of what we do with data, and it is the document to read before you connect a selling account. Security and data handling describes the controls behind that statement, for the reviewer who needs specifics.
Order of precedence
If two of these documents disagree, they control in this order, and only on the point that actually conflicts:
- a signed order form or written agreement between us;
- the Terms of Service;
- the End User License Agreement;
- every other document and policy we publish, including the Privacy Policy.
The limitation of liability is shared rather than stacked: the Terms of Service and the EULA carry the same cap, and a single course of events produces one cap, not two.
How we tell you about changes
We can change these documents. When a change is material, we email the active administrators of every organization at least 14 days before it takes effect, and we update the effective date shown on the document and on this page. Continued use after that date is acceptance. Non-material changes, such as fixing a typo or clarifying wording that was already true, take effect when published.

A note about Amazon
MarketMonster is an independent third-party tool for Amazon Selling Partners. It is not affiliated with, endorsed by, or sponsored by Amazon.com, Inc. We access your selling account only through the Selling Partner API (SP-API), only under the roles you authorize, and only while that authorization is live. Your agreement with Amazon is yours, and nothing in our documents changes it.
